What is Probate and who applies for it?
Probate is the process of obtaining the necessary authority in order to be able to collect in the
assets of the deceased person for distribution to the beneficiaries. The person who
applies is named in the will as an Executor or is governed by the law of Intestacy.

Your spouse or civil partner does not inherit automatically there are complex rules
governing the distribution of estates where there is no will.

Grant of Probate is taken out when there is a Will. Letters of Administration are applicable when there is, no valid will, or the deceased is intestate.
